{"id":592,"date":"2019-03-22T15:24:59","date_gmt":"2019-03-22T21:24:59","guid":{"rendered":"https:\/\/ahlulkahf.wordpress.com\/?p=592"},"modified":"2019-03-22T15:24:59","modified_gmt":"2019-03-22T21:24:59","slug":"shafii-fiqh-hijrah-in-our-time","status":"publish","type":"post","link":"https:\/\/hanbali.org\/?p=592","title":{"rendered":"Sh\u0101fi`\u012b Fiqh: &#8220;Hijrah in Our Time&#8221;"},"content":{"rendered":"<div id=\"js_l\" class=\"_5pbx userContent _3ds9 _3576\">\n<p><em>Al-\u1e24\u0101w\u012b al-Kab\u012br f\u012b Fiqh Madh\u2019hab il-\u2018Im\u0101m ash-Sh\u0101fi`\u012b<\/em><\/p>\n<p>By \u2018Ab\u016bl-\u1e24asan `Al\u012b bin Mu\u1e25ammad al-M\u0101ward\u012b [d. 450 AH \/ 1058 CE]<\/p>\n<p>Translated by Abu Najm bin al-Iskandar<\/p>\n<p>Section: As for Hijrah in our time, then it applies specifically to whoever accepts Islam in D\u0101r al-\u1e24arb, in terms of Hijrah from it to D\u0101r al-Islam; and [Hijrah] is not specific to the land of the Im\u0101m [i.e. Khal\u012bfah].<\/p>\n<p>The circumstances of Hijrah are divided into 5 categories:<\/p>\n<p>1) To be able to abstain [\u2018Imtin\u0101`] in D\u0101r al-\u1e24arb through isolation [I`tiz\u0101l, from non-Muslims] and to be able to call [to Islam] and fight [Qit\u0101l]. [In this case] it is obligatory to remain in D\u0101r al-\u1e24arb because it will become D\u0101r al-Islam through [the Muslim\u2019s] Islam and isolation [from non-Muslims]. And it is obligatory [for the Muslim in this circumstance] to call the polytheists to Islam by any means his is able to whether assisting through argumentation or fighting [Qit\u0101l].<\/p>\n<p>2) To be able to abstain and isolate [oneself from non-Muslims] and to not be able to call [to Islam] and fight [Qit\u0101l]. [In this case] it is obligatory to remain and not perform Hijrah because his land has become D\u0101r al-Islam through his isolation and if he were to perform Hijrah from it, it would return to being D\u0101r al-\u1e24arb. Calling [to Islam] and fighting [Qit\u0101l] is not obligatory for him due to his being incapable\/too weak for it.<\/p>\n<p>3) To be able to abstain and not to be able to isolate oneself nor call [to Islam] or fight [Qit\u0101l]. [In this case] remaining is not obligatory since his land did not become D\u0101r al-Islam. Nor is Hijrah obligatory for him since he is able to abstain [\u2018Imtin\u0101`]. There are 3 circumstances for this person:<\/p>\n<p>A) If there is hope for the emergence of Islam through his staying, then it is better for him to stay and not perform Hijrah.<br \/>\nB) If there is hope of assisting the Muslims with his Hijrah, then it is better for him to make Hijrah and not stay.<br \/>\nC) If his circumstances are equal in terms of staying or making Hijrah, then he may choose between remaining or Hijrah.<\/p>\n<p>4) To not be able to abstain and to be able to make Hijrah, then it is obligatory for him to make Hijrah and he is disobedient if he remains.<\/p>\n<p>And regarding this individual, the Messenger of Allah \ufdfa said: <em><strong>\u201cI am free from every Muslim with a polytheist.\u201d<\/strong><\/em> It was said: \u201cWhy, oh Messenger of Allah?\u201d He \ufdfa replied: <em><strong>\u201cTheir fires should not be visible to one another.\u201d<\/strong><\/em><\/p>\n<p>What it means is that their views should not coincide and \u201cthe fires\u201d are expressions for \u201cviews\u201d because a person will seek guidance through views just as he will seek the light of a fire [for seeing].<\/p>\n<p>An example of this is in what is transmitted on authority of the Prophet \ufdfa: <em><strong>\u201cDo not seek the light of the fire of polytheists,\u201d<\/strong><\/em> in other words do not look to guidance from their views and way of thinking.<\/p>\n<p>5) To not be able to abstain and to be too weak to make Hijrah. [In this case, the obligation of] Hijrah drops from the person due to his inability to do so. It is permissible to defend himself through manifesting Kufr [I\u1e93h\u0101r al-Kufr] and to be Muslim through belief in Islam and compliance with its legal rulings [A\u1e25k\u0101m].<\/p>\n<p>It is not permissible for someone capable of making Hijrah to manifest Kufr because he is not compelled to do so while the one who is incapable of making Hijrah is someone compelled.<\/p>\n<p>The obligation of Hijrah remains [in effect] as long as a land for polytheism remains and there is someone who believes [in Islam] in [that land].<\/p>\n<p>Mu\u2019\u0101wiyah bin Ab\u012b Sufy\u0101n transmitted: I heard the Messenger of Allah \ufdfa say: <em><strong>\u201cHijrah will not be cut-off until repentance is cut-off. And repentance will not be cut-off until the sun rises from the west.\u201d<\/strong><\/em><\/p>\n<p>If it is said- Ibn `Abb\u0101s transmitted on authority of the Prophet \ufdfa that he said on the day of the conquest of Makkah: <em><strong>\u201cThere is no Hijrah after today, however [there is still] Jih\u0101d and intention.\u201d<\/strong><\/em><\/p>\n<p>It is said that there are two ways to explain it:<\/p>\n<p>1) There is no Hijrah from Makkah after today because after the conquest it has become D\u0101r al-Islam.<br \/>\n2) There is no merit in making Hijrah after today like the merit of doing so before today because before the conquest, it was more difficult [to do so] than afterwards.
